Terms and Conditions

The Purchaser agrees to make all payments in accordance with the terms and conditions of this contract. The Purchaser also agrees that non-payment of all or any part of the agreed upon amount shall render all Seller’s warranties null and void.

Both parties agree that NO modification to the contract shall be enforceable unless it is in writing and signed by both parties.

FORCE MAJEURE: delays caused by floods, strikes, illness, labour disputes, late delivery of material, accidents, acts of God or other causes beyond the reasonable control of the Seller shall excuse or extend the time for performance of the contract.

The Purchaser understands that if any portion of this contract is illegal or unenforceable it will not render the whole contract null or void and all other terms will remain in effect.

PAYMENTS:

A payment schedule noting deposit and payment amounts has been detailed on the quotation.

Any changes to the agreed upon plans and specifications may result in additional costs. The Seller will notify the Purchaser of cost of any such changes before implementation and the Purchaser agrees to pay such additional costs upon presentation of the invoice by the Seller.

All prices that are based on plans or measurements provided by Purchaser may be subject to increase in the event of any inaccuracies.

REFUNDS/EXCHANGES/ CANCELLATIONS:

This agreement may be cancelled unilaterally by Purchaser by at any time prior to installation. In the event of such cancellation, the Seller has the right to retain the whole of the deposit.

If the purchaser cancels the contract after the start of installation, they will be responsible for the full cost quoted cost of the work, irrespective of delivery or installation.

All worktops that are made from granite, wood or other naturally occurring material will have variations in their appearance (patterns, streaks, colour variances, etc.) and that this is not sufficient cause to seek replacement.

The Purchaser acknowledges that ALL worktops may stain, scratch or burn if mistreated, and understands that reasonable care and maintenance is the responsibility of the Purchaser.

The Seller has the right to cancel the job at any time without penalty. If Seller cancels the contract, the Seller agrees to refund any portion of the Purchaser’s deposit/payment that pertains to products not yet delivered and/or services not yet rendered.

PREPARATION
-
The Purchaser agrees to have all work areas cleared and ready for the installers when they arrive.

Unless otherwise specified, the Purchaser’s responsibility includes the removal of all of the contents of the existing kitchen furniture and loose furniture (tables, chairs etc.) so that the Seller shall have clear access to the work area. The Seller is not responsible for damage to furniture as a result of moving furniture or other items interfering with the installation.

PROFESSIONAL INSTALLATION

The Purchaser is aware that the removal and installation of the kitchen products may create dust in the air and the Purchaser has taken such precautions as he/she feels adequate to protect the surrounding area from such dust. Seller shall not be held responsible for any damage resulting from dust nor shall the Seller be responsible for removing such dust.

The Purchaser understands that installing a kitchen is a construction project and agrees to vacate the area during the project. The Purchaser agrees that any injuries that occur as result of the Purchaser not vacating the area will not create any liability on the part of Seller.

Purchaser understands that during the installation, some damage to walls/trim or ceilings may occur. Unless otherwise agreed, the Seller will not be held responsible for repairing, replacing and/or painting of these items.

Purchaser understands that installing cabinets/ worktops is a construction project which, in process, may expose unforeseen barriers to the proper completion of the contracted work. Any unforeseen repairs to, or preparation of, the job site are not the responsibility of the Seller. Any additional work undertaken as a result of unforeseen repairs will be priced and agreed to prior to doing additional work. Purchaser agrees to pay for this additional work upon completion of work.

Granite/quartz/solid worktops will normally be installed within 1-2 weeks of cabinets. Precise measurements must be made after final cabinet installation to ensure accurate fabrication of granite worktops.

The Purchaser understands that Seller may hire independent contractors for installation work. If any other work is negotiated privately negotiated between the independent contractor and Purchaser, the Seller has no liability with regards to such work

Seller warrants the installation of the cabinets for one year from the installation date. This warranty is for defects in workmanship only. Warrants for kitchen furniture, worktops and appliances supplied by the Seller will be provided by the respective manufacturer.

PRIVATE PROCUREMENT OF COMPONENTS OR APPLIANCES (if applicable)

If the Purchaser elects to procure and provide any electrical appliances or other components of the kitchen then if the appliances or components are to be fitted by the Seller, the Purchaser must make arrangements to accept delivery, unpack and inspect any such items for damage or defects. The Seller has no responsibility for the fitness for purpose of any such appliances or components.

SELF-INSTALLATION (if applicable)

The Seller accepts no liability for damages incurred during assembly or installation undertaken by the Purchaser or the Purchaser’s Agent. This applies to a full installation or any part thereof.

The Seller will not be responsible for any necessary adjustments to hinges, tracks or slides required to accommodate the installation.

The Seller must be notified of any pre-existing damage within 24 hours of delivery or collection; otherwise, no exchanges will be allowed.

MISC.
-
The Seller will is responsible for installation of only for items mentioned in the Quotation. Any additional requirements may incur extra charges which will be discussed and agreed in writing before commencement.

The Purchaser accepts responsibility for materials delivered to job site in good order by Seller or his suppliers and agrees to provide protection against theft and damage from the elements.
